The Issue and its Facts

Over the past 60 years the Federal Government has seized important powers that the Constitution clearly designates to the states. Consider education, health care and housing – yes, even abortion. These powers are never mentioned in the Constitution, and are therefore, the responsibility of each state to administer as each state sees fit.

One size does not fit all, e.g. one public school system does not fit all. Fifty competing ideas are better than a monopoly. Eventually the good ideas will win out over the ill-conceived ideas. Let the market of ideas decide.

Thinking Conventionally

Government is good. The public wants it (Federal aid, hate crimes, education reform …). We can fix it. With your money, we can fix the world. Power is everything. Demagoguery works. “Free Stuff” buys votes. Unions are our best constituents. Special interests support us for reelection. Wall Street loves us. Demonize our opponents. Read Rules for Radicals.

Thinking Better

Government is a necessary evil; it must be limited. The Constitution is the social contract or covenant that binds our nation together. It is to be interpreted as the signers, the Founding Fathers originally intended it to be, not as our modern wishes would prefer it to be. The Constitution is quite clear in delineating which power are given to the Federal Government and which are retained by the Sovereign States. A combination of circumstances (legal errors, fiscal strings, civil rights issues…) have all but destroyed the legal boundaries between the authorities of the Federal and State governments. Today the Congress routinely usurps the sovereign authorities of the States.
